Identification and Application of the General Conditions of Sale

These general conditions of sale are agreed between CPS – Centro Português de Serigrafia, headquartered at Rua dos Industriais, 6 – 1249-023 Lisboa, Portugal, tax identification number 501 678 638 and contact +351 213 933 260, hereinafter referred to as "CPS" and individuals who wish to make purchases through the website www.cps.pt, hereinafter referred to as "User".

The parties agree that purchases made through the website www.cps.pt will be governed exclusively by this contract, excluding any conditions previously available on the website.

 

Object and Scope of Application

The purpose of these general conditions of sale is to provide and define all necessary information for the User regarding the methods of ordering, selling, payment, and delivery of purchases made on the website www.cps.pt.

These conditions regulate all the steps necessary to place the order and ensure its follow-up between the contracting parties.

 

Order

The User completes their order through the completion of the purchase process presented on the website www.cps.pt, adding the product(s) they wish to order to the shopping cart.

To place the order, the User must:

a) Register on the website www.cps.pt, providing the requested information.

b) Log in (providing a combination of email and password chosen by the User during registration).

c) Complete the information and choose the options available throughout the order completion process (delivery and billing address, shipping method, payment method, as well as the tax identification number and the name to be included on the invoice for tax purposes).

The User's final confirmation of the order constitutes full and complete acceptance of the prices and descriptions of the products available for sale, as well as these General Conditions of Sale, which will be the only ones applicable to the contract thus concluded.

CPS will honor orders received online only up to the limit of available stock. In the event of unavailability of the product, CPS commits to informing the User as soon as possible.

The data on the invoice are the sole responsibility of the User. The invoice cannot be reissued with changes once it has been issued.

Order requests are valid for fifteen days - unless the order is placed under a promotional campaign that defines a different period - and it is not possible to guarantee prices, discounts, promotions, and offers beyond this period.

 

Payment

On the website www.cps.pt, CPS offers the User the following payment methods:

 

Via Easypay

Easypay is a Portuguese company that offers a universal payment platform and is certified by SIBS, Unicre, Visa, MasterCard, and PaysafeCard. Card details are sent securely, through encrypted data, directly to Easypay's server (www.easypay.pt), without access by CPS.

a) Credit Card (Visa, Mastercard).

b) Multibanco Reference (valid only for Portugal). With the generated Reference, the User can pay for their order directly at an ATM or Homebanking service on the internet. Payment must be made within 5 days of placing the order. If payment confirmation is not received within the indicated period, the order will be canceled.

 

Via Paypal

With PayPal, the User's financial information is never communicated to CPS. PayPal encrypts and permanently protects your card number.

In the case of payment by credit card, the debit will be made on the User's card immediately after confirmation of the shipment of the goods. If some ordered products are out of stock, their value will be credited to the User's card after the order is closed.

 

Delivery

During the ordering process, the User can choose to receive their artwork at no cost at a CPS gallery in Lisbon.

They can also receive it at the address of their choice (home, work, etc. - except for P.O. boxes), with an associated cost, according to the destination and the number of items in the order:

The mentioned prices apply to tube shipping of paper works up to 100 cm. For works that require other types of packaging due to their format or other characteristics, CPS will inform the client in advance by phone or email about the applicable shipping costs.

*Prices are subject to change, depending on the work(s) and the destination country.

 

Pick-up at a CPS gallery in Lisbon will be available between 3-5 business days after the order.

Delivery of orders in Continental Portugal will take place up to 5 business days after order validation.** Delivery is made to the address indicated by the User.

In the case of shipments to the Azores, Madeira, and International, delivery times can be extended up to 2 weeks (10 business days).** The User will be informed of the expected date for receiving their order. If the receipt of the order exceeds the expected times, they should contact CPS.

For international shipments, the values and times do not include customs duties and times.

** Except for exceptional situations, such as holiday periods or festive seasons.

 

Prices

Prices are understood to be in Euros, including taxes, taking into account the VAT in force at the date of payment of the order.

If there is an increase in the prices of any product, the User will be immediately informed, being able to choose to receive their order (making the payment of the difference) or to proceed with its cancellation.

CPS cannot be held responsible in case of an IT, manual, technical, or any other origin error that causes a substantial unforeseen change in the public sale price and/or member price listed on the CPS website, so in these cases, the purchase order will be considered invalid and canceled.

 

Cancellation and Return

The cancellation or return process is handled on a case-by-case basis by CPS. The request must be made in writing to the email contacto@cps.pt, within fifteen days of receiving the order, and the cancellation or return instructions will be responded to and defined by CPS through the same communication means.

Whenever possible, the refund should be made by the same payment method. If this is not possible, the User must present payment and account or card ownership proof, for the refund to be made by Bank Transfer.

CPS commits to refund the User within a maximum of fifteen days.

The simplest way to return or exchange a work is through a CPS gallery. If this is not possible, the User must send the order in its original packaging to the following address: Rua dos Industriais, 6 - 1249-023 Lisboa.

Returned products must be in saleable condition, that is, in the same state they arrived at the User's hands, without any anomaly or damage.

If the resulting value of the product exchange of an order is lower or higher than the initial value of the same, the adjustment conditions will be indicated by CPS.
